Can my current husband adopt my son?

Either a little back story, right after you got pregnant with my son, he was the father and had no contact with us for over a year and I'm getting married soon and already have another baby on the way and he (the new husband) wants to adopt my son. I have no idea where the father and he's not on the birth certificate and no paternity tests have already been published, if the husband can only sign the birth certificate and be done with it, or if you go through your father and if so, what if we never find him. (Support for children has been the search for a year with no possibility of them to get a paternity test for him) * Side note, I think that is still in New Mexico and I'm in Ohio. Thanks in advance!

If you are on the birth certificate the biological father would have to petition the rights of the child anyway. However, I am pretty sure her husband will through a formal adoption and not simply sign the birth certificate. It would be a safer option as well. Once your child was legally adopted by her husband, the biological father would have a difficult time ever backing. The sounds of things, you may not try, but you never know. My sister passed a similar situation, and that devastated my nephew. His "father" had no contact with him until he was 7 and then decided to fight for the rights of visit. Because it was included on the birth certificate, were assigned. We live in Texas, and although he never paid a penny in support of children and leaves his job when captured the pay, my sister has no choice but to allow him to my nephew for a weekend. Suggest that treaties be approved as soon as possible. It is different from adoption of an abandoned child and is a fairly simple procedure. Good luck and Congratulations!
